Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Free.ai website, tools, API, and related services (collectively, the "Service") operated by Muddy Holdings LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the Service, you confirm that you are at least 13 years of age and that you accept and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

To access certain features, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@free.ai if you suspect unauthorized use of your account.

You may not create multiple accounts to circumvent usage limits. We reserve the right to suspend or terminate accounts that violate this provision.

3. Free Usage and Daily Limits

Free.ai provides a daily allowance of free tokens to all users. These free tokens replenish at midnight UTC each day. Free tokens are provided on a best-effort basis, and we may adjust the daily allowance at any time without notice.

4. Paid Plans and Token Billing

We offer paid plans that provide additional tokens and features. When you purchase a plan:

• Payment is processed securely through Stripe. We do not store your full credit card information.
• Tokens purchased through paid plans never expire and remain in your account until used.
• Free daily tokens are consumed first; your purchased tokens are only used after your daily free allowance is exhausted.
• All prices are listed in US dollars unless otherwise stated.
• Subscriptions renew automatically unless canceled before the renewal date.

Refunds are subject to our Refund Policy.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Generate child sexual abuse material (CSAM) or any content that sexually exploits minors.
• Use the Service to develop weapons, malware, or tools intended to cause harm.
• Attempt to bypass rate limits, abuse free tiers, or create multiple accounts to gain additional free usage.
• Reverse engineer, decompile, or attempt to extract the source code of our proprietary software.
• Use automated scripts, bots, or scrapers to access the Service except through our published API.
• Resell or redistribute access to the Service without our written consent.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Upload content that infringes on the intellectual property rights of others.

We reserve the right to suspend or terminate your access if you violate these terms.

6. Your Content

You retain ownership of all content you submit to the Service ("Input") and all content generated by the Service based on your Input ("Output"), to the extent permitted by applicable law. You are solely responsible for your Input and for ensuring it does not violate any third-party rights or applicable laws.

AI-generated Output may not be unique. Other users providing similar Input may receive similar or identical Output. We make no claim of exclusivity over any Output.

We do not use your Input or Output to train our models without your explicit consent.

7. Intellectual Property

The Service, including its design, branding, software, and documentation, is owned by Muddy Holdings LLC and protected by copyright, trademark, and other intellectual property laws. "Free.ai" is a trademark of Muddy Holdings LLC. You may not use our trademarks without prior written permission.

8. Third-Party Services and Models

The Service provides access to two categories of AI models:

Self-Hosted Models: Models we run on our own GPU servers. These are all open-source with commercial licenses (MIT, Apache 2.0, BSD). Outputs from self-hosted models are yours for any purpose, including commercial use. Self-hosted models include: Qwen 2.5 (Apache 2.0), Kokoro (Apache 2.0), faster-whisper (MIT), Stable Diffusion XL (OpenRAIL++), and others.

External Models (via OpenRouter): Models hosted by third-party providers and accessed through OpenRouter's API. These include models from OpenAI, Anthropic, Google, Meta, and others. Each provider has their own terms of service and acceptable use policies that apply to your use of their models. Some models (e.g., Meta's Llama) have non-standard licenses that may restrict certain commercial uses. We do not host these models — they are processed by their respective providers. Please review the applicable provider's terms before using external models for commercial purposes.

We clearly label which models are self-hosted vs. external in our model listings. We are not responsible for the output of third-party models.

9. API Usage

If you use the Free.ai API, you agree to comply with our API documentation and any applicable rate limits. API access may be revoked if you abuse the service or violate these Terms.

10. Availability and Modifications

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT IS ACCURATE, COMPLETE, RELIABLE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUDDY HOLDINGS LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Muddy Holdings LLC from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination:

• Your access to the Service will cease immediately.
• Any unused purchased tokens may be forfeited unless a refund is requested within our Refund Policy window.
• We may delete your account data in accordance with our Privacy Policy.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and may notify you via email or a notice on the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
